Baby formula maker agrees to settle suit alleging it blocked competitors
Baby formula maker agrees to settle suit alleging it blocked competitors A news briefing from Farm Action’s policy team Oct 15, 2026 Infant formula maker agrees to $10 million settlement over alleged price-fixing What happened: Infant formula manufacturer Perrigo has agreed to pay $10 million to settle a class-action antitrust lawsuit alleging it conspired with Gerber to block new competitors from entering the store-brand infant formula market. The lawsuit alleges that the companies’ agreement protected Perrigo’s market dominance, allowing it to charge higher prices that retailers passed on to consumers. Perrigo denies wrongdoing, and the settlement is subject to court approval. Source: Reuters Why it matters: Like eggs and fuel, infant formula is a necessity that families cannot simply stop buying when prices rise. That makes these markets particularly vulnerable to exploitation by companies with market power. But infant formula is an especially egregious example: parents who depend on it have virtually no alternative. Allegations that manufacturers deliberately restricted competition to inflate prices raise serious concerns about companies profiting from families who have no choice but to pay.
